Terms of Service

These Terms of Service govern your use of Daystar Distro. By creating an account, submitting releases, or using our platform, you agree to these terms.
1. Acceptance of Terms
By using Daystar Distro, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
2. Service Description
Daystar Distro provides a web-based music distribution platform for independent artists. Services include account management, release submission tools, distribution delivery through partners, and payout operations for eligible royalties.
3. Eligibility
You must be at least 18 years old, or have permission from a parent or legal guardian, to use Daystar Distro. By using the service, you represent that you have legal authority to agree to these terms.
4. Account and Security
You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate registration and payout information and keep it up to date.
5. Your Content and Rights
You retain ownership of your music and related content. By uploading content to Daystar Distro, you grant us a limited, non-exclusive license to:
- Distribute your music to digital service providers
- Store, process, and transmit your content to operate our services
- Display release metadata and artwork as required for service operation
6. Your Responsibilities
You represent and warrant that:
- You own or control all required rights for submitted content
- Your content and metadata do not infringe third-party rights
- Your content complies with applicable law and platform policies
- All information you submit to Daystar is accurate and current
7. Plans, Pricing, and Payment
Current plans and pricing are listed on Daystar public pages and checkout surfaces. As of this update:
- Nova: Single $5.99 (1-2 tracks), EP $12.99 (3-6 tracks), Album $19.99 (7-25 tracks)
- Orion: $29.99 per year founders pricing (regularly $39.99) for unlimited uploads while active
- Priority Delivery: Included on Orion, +$24.99 on Nova unless an active offer states otherwise
Nova is billed per release. Orion is billed annually and must remain active for Orion benefits to apply. If Orion is not renewed, your catalog is not automatically removed and your account moves to Nova terms at the end of the active Orion term.
Payment processing is handled by third-party providers. You authorize us and our providers to charge applicable fees, taxes, and related charges for services you request.
Refund Policy:
- If you pay but do not complete and submit a release, you may request a full refund within 30 days by contacting [email protected]
- Once a release is submitted for distribution, fees are non-refundable
- Approved refunds are generally processed within 5-7 business days to the original payment method
8. Royalties and Payouts
For releases submitted under Nova, you receive 80% of net royalties collected. For releases submitted under an active Orion plan, you receive 100% of net royalties collected for those releases while Orion is active.
"Net royalties" means royalties actually received by Daystar after platform deductions, adjustments, taxes, chargebacks, withholding, and any streams or royalties invalidated for fraud, artificial streaming, or similar enforcement.
Payouts are sent quarterly, subject to a $25 minimum threshold and successful payout setup. Unpaid balances below threshold roll into future payout periods.
9. Content Rules and Platform Compliance
Your content must not:
- Infringe intellectual property or publicity/privacy rights
- Contain unlawful, abusive, hateful, deceptive, or fraudulent material
- Include malware, malicious files, or code designed to disrupt systems
- Violate DSP policies or applicable law
10. Review, Rejection, and Takedowns
You may request takedowns at any time. We may refuse, suspend, remove, or disable releases that fail quality checks, violate policy, trigger legal claims, or present fraud/compliance risk.
We cannot guarantee specific go-live timing on third-party platforms because timing is affected by partner review and policy systems outside Daystar control.
11. Account Deletion Requests
You may request account deletion through your account profile surfaces. Deletion requests include a mandatory 7-day waiting period before completion. During that period, you may cancel the request.
12. Service Availability
We aim to provide reliable service but cannot guarantee uninterrupted availability. Outages, delays, maintenance windows, or third-party disruptions may affect platform behavior.
13. Limitation of Liability
To the fullest extent allowed by law, Daystar Distro's total liability for claims related to the service is limited to the amount you paid us for the affected services. We are not liable for indirect, incidental, consequential, special, or punitive damages.
14. Indemnification
You agree to indemnify and hold harmless Daystar Distro, Daystar LLC, and affiliated personnel from claims, losses, and expenses arising from your content, rights claims, law/policy violations, or breach of these terms.
15. Changes to Service or Terms
We may modify services, plans, pricing, workflows, or these terms at any time. Updated terms become effective when posted. Continued use after updates means you accept the revised terms.
16. Governing Law
These terms are governed by the laws of the State of Nevada, without regard to conflict-of-law principles.
